Acceptable Use Policy




ReachONE Internet Acceptable Use Policy

1. Introduction

By using Services provided by a subsidiary of ReachONE, Inc. (including, but not limited to, ReachONE Internet, Olympic Network Communications, The Connect Corporation, TurboTek, Connect! delSol, South Puget Sound Online, WorldStar Internet Technologies, North West Rain Networks, OrcaLink, and NWTekk) ("ReachONE"), you agree to comply with this Policy.

You are expected to use the Internet with respect, courtesy, and responsibility, giving due regard to the rights of other Internet users. We expect you to have a basic knowledge of how the Internet functions, the types of uses that are generally acceptable, and the types of uses that must be avoided. Common sense is the best guide as to what is considered acceptable use.

Failure to observe the guidelines set forth in this Acceptable Use Policy (“AUP”) can result in anything from a warning to a suspension of privileges or termination of your Service. Decisions of ReachONE's staff are final. ReachONE may refer potential violations of laws to the proper authorities, may cooperate in the investigation of any suspected criminal or civil wrong, and will cooperate with authorities when required to do so by law, subpoena, or when the public safety is at stake. ReachONE assumes no obligation to inform a member that the member's information has been provided and, in some cases, may be prohibited by law from giving such notice.

2. General Use Policy

In this Policy, "Service(s)" refers to, but is not limited to, any dial-up Internet access, Digital Subscriber Line Internet access (“DSL”), web hosting, co-location, satellite Internet access, wireless Internet access, leased line Internet access, such as frame relay, or similar services that you may have purchased from ReachONE. Your use of these Services is subject to the terms and conditions of the Terms of Services Agreement (“Terms of Service”) you accepted in conjunction with the Services you purchased from ReachONE. This Policy is intended to provide you with a set of guidelines you must follow in your use of your account. You are responsible for avoiding the prohibited activities and following the Policy set forth herein. Violations of this Policy, and therefore the Terms of Service, may result in action including, but not limited to fines, or suspension or termination of your account.

3. Definitions

Account Owner (“Owner”) – The account holder of record. This person or organization is responsible for all use of the account, with our without the knowledge or consent of the Owner.

Account User (“User”) – The User is defined as any person who uses the Service, with our without the knowledge or consent of the Owner.

4. Prohibited Conduct

Illegal Use - User is prohibited from storing, distributing, or transmitting any unlawful material on ReachONE Services. Examples of unlawful material include but are not limited to direct threats of physical harm, child pornography, and copyrighted, trademarked, and other proprietary material used without proper authorization.

Unsolicited Bulk/Commercial E-mail (“Spam”) – User is prohibited from sending Spam though ReachONE Services. Further, User is prohibited from sending Spam through Services provided by a third party entity to promote any content provided through ReachONE Services.

Fraudulent Activity – User is prohibited from using the Services to make fraudulent offers to sell or buy products, items, or services. This includes, but is not limited to, “pyramid schemes,” and “chain letters.”

Forgery or Impersonation – User is prohibited from removing, modifying, or adding additional identifying network header information in an effort to deceive or mislead ReachONE or other third party entity from identifying the origination of any content. The use of anonymous remailers or nicknames does not constitute impersonation. User may deliberately include misleading headers (“munging” headers) in Usenet postings in order to avoid spam e-mail address collectors. Munging headers in E-mail is prohibited.

Unauthorized Access – User is prohibited from using the Services to access, or attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of ReachONE’s, or another third party entity’s, computer software or hardware, or telecommunications system.

Collection of Personal Data – User is prohibited from using the Services to collect personal data about any other user without their consent.

Network Disruptions – User is prohibited from using the Services in any way that adversely affects the ability of other people or systems to use ReachONE systems or the Internet. This includes Denial of Service attacks, as well as other forms of disruption. It is the Owner’s and User’s responsibility to secure their systems and network. A Owner or User may not permit their network, through action or inaction, to be configured in such a way that gives a third party the capability to use their network in an illegal or inappropriate manner. Protections include, but may not be limited to, firewalls and antivirus products.

Usenet – User should use their best judgment when posting to any Usenet Newsgroup. Most groups have charters or frequently asked questions files (“FAQ”) describing what constitutes an “on topic” post. The continued posting of “off topic” messages is prohibited. This includes, but is not limited to, commercial postings, Spam, and abusive or harassing posts.

Multiple Logins and Long Connections – Personal and Small Business accounts are for a single session at any time. Using a Personal account for commercial purposes is prohibited. These Services are intended for periodic, active use of e-mail, newsgroups, file transfers, Internet chat, games, and browsing of the World Wide Web. Users may stay connected so long as they are actively participating in one of these activities. Users may not leave their system connected to the Service while not actively using the Service. Pinging or leaving an e-mail program checking mail periodically while not using your system is prohibited. ReachONE reserves the right to disconnect any User found to be idle for 20 minutes, or continuously connected for 8 hours.

Excessive Web Site Size and Traffic Limitations– All ReachONE Internet access accounts receive free webspace for their use. ReachONE reserves the right to suspend any webspace if it is found to be in excess of its allotted size, or to be using an excessive amount of system resources or data transfer, pending a review with the customer. Additional space and traffic allotment can be purchased for an additional fee.

Excessive E-mail Mailbox Size – All ReachONE e-mail addresses receive 50 Megabytes (“MB”) of disk space allocated for temporary storage of e-mail on our servers. ReachONE reserves the right to suspend any e-mail address if it is found to be in excess of its allotted size. Additionally, ReachONE reserves the right to delete from our servers any mail that has not been accessed for a period of 3 months. Additional space on the server can be purchased for an additional fee.

Bandwidth Utilization – Each User is allocated an amount of bandwidth, calculated in total data transfer per calendar month. ReachONE reserves the right to place an account on hold, or to add an additional fee to each account that exceeds these utilization guidelines.

5. Reporting Violations of ReachONE’s AUP

ReachONE requests that anyone who believes that there has been a violation of this AUP direct the information to our Abuse Department at: abuse@reachone.com.

If available, please provide the following information:

  • The IP Address used to commit the alleged violation

     

  • The date and time of the alleged violation, including the time zone or offset from GMT

     

  • Evidence of the alleged violation

     

A forwarded e-mail or newsgroup post with the full headers intact provides all of the above information, as well as syslog files. Other situations may require different methods of providing the same information.

6. ReachONE’s Response to AUP Violation Reports

Upon receiving a report about an AUP violation, ReachONE may launch an Investigation. This Investigation may include, but is not limited to, any of the following activities:

  • Requests for further information from the complaining party
  • Requests for further information from the account Owner
  • Examination of evidence supplied with initial report, if any
  • Temporary suspension of the account(s) involved
  • Tracking of any and all communication any Users of account perform, including, but not limited to, e-mail, newsgroups, and web browsing.

If ReachONE believes, in its sole discretion, that a violation of the AUP has occurred, it may take any of the following actions:

  • Issue a verbal or written warning
  • Suspend Usenet posting privileges
  • Suspend the account(s)
  • Termination the account(s)
  • Bill the Owner for administrative costs and/or reactivation charges
  • Bring legal action to enjoin violations and/or to collect damages, if any, caused by violations

7. Revisions to this Acceptable Use Policy

ReachONE reserves the right to revise, amend, or modify this AUP, the Terms of Service, or any other policies and agreements at any time. Notice of any revision, amendment, or modification will be posted on our web site at http://www.reachone.net.
